PART Lan 302 QUALIFICATIONS

Lan 302.01 Candidate Requirements.

  1. Candidates for licensure shall meet the requirements established by RSA 310-A:63 before a license shall be granted. The board shall require documentation of the applicant's education and work products to help determine competency. Applicants shall appear for a personal audience with the board if their records of education or experience are unclear, contradictory or incomplete to enable the board to make an informed decision.
  2. As authorized by RSA 310-A:58 II, all candidates for licensure shall demonstrate satisfactory evidence of good professional character. The board shall consider all available evidence of professional character for all candidates for licensure, prior to granting any license. Substantiated evidence of poor professional character shall result in denial of licensure to any candidate.

Lan 302.02 Experience Requirements.

  1. As required by RSA 310-A:63, as minimum evidence satisfactory to the board that a person is qualified to be considered for licensing as a professional land surveyor, he/she shall have a specific record of 6 years or more accumulated experience in land surveying work.
  2. Any applicant who has pursued a curriculum of surveying, engineering, forestry, or forestry technician in an institution of higher learning shall be credited with 6 months basic experience for any semester completed at such institution, so long as the applicant completed and passed with a satisfactory grade at least 1 course in land surveying during said semester. Total education credits claimed shall not exceed 4 years of accumulated experience.
  3. Professional experience claimed under Lan 301.01(c)(5) shall require an affidavit stating the dates of employment and the type of services provided during said employment, and the names and addresses of all employers/clients referenced. Professional experience shall be attained while under the direct full-time supervision of a licensed land surveyor, and shall be of a responsible charge character. Responsible charge, as used in this context means the applicant gained experience through performing and being responsible for project management, research, coordination of field surveys and/or field crews, computations of data, boundary line determinations, preparation of plans, and monumentation of surveyed positions.
  4. Each applicant shall demonstrate to the board by professional portfolio/resume, documentation of proficiency in project management, research, field survey, computations, legal principles/reconciliation/ boundary determination and perPetuation.
  5. The applicant shall demonstrate proficiency in project management in the following areas:

    1. Initial review of project and potential problems;
    2. Consultations with clients/owners and/or clients' agent;
    3. Determining procedures to comply with ethical conduct and precision requirements;
    4. Planning for and supervision of field reconnaissance procedures;
    5. Contacting adjacent land owners regarding boundary and/or entry rights;
    6. Determining requirements of and designing subdivision developments; and
    7. Making application for and receiving approvals from various government agencies.

  6. The applicant shall demonstrate proficiency in research in the following areas:

    1. Researching subject title and abutting title deeds and record plans at county registry of deeds;
    2. Researching applicable probate court records as necessary;
    3. Researching road, railroad and utility plans and records;
    4. Researching governmental records, rules, regulations, and statutes;
    5. Researching documents not recorded at the county courthouse, such as survey notes and plans, aerial photographs, and ancient plats;
    6. Consulting with other surveyors of the area;
    7. Gathering parole evidence;
    8. Researching court records and reports; and
    9. Researching assessors' records.

  7. The applicant shall demonstrate proficiency in field survey in the following areas:
    1. Performing boundary surveys;
    2. Performing topographic, title insurance, subdivision, probate court partition, route or right-of-way, or as-built surveys; and
    3. Performing control surveys.

  8. The applicant shall demonstrate proficiency in computations in the following areas:

    1. Computing coordinate values, computing & reviewing closures, and adjusting traverses;
    2. Computing areas and/or volumes; and
    3. Preparing worksheets of surveys for final drafting and to assist boundary determinations.

  9. The applicant shall demonstrate proficiency in legal principles/reconciliation/boundary determination in the following areas:

    1. Reconciling researched records with field data and evidence;
    2. Identifying boundary line discrepancies and reconciling conflicting deed descriptions;
    3. Considering evidence of possession, potential adverse possession claims, priority of calls, and littoral boundaries;
    4. Determining location of easements;
    5. Considering parole evidence;
    6. Analyzing and evaluating all things a.- e., above;
    7. Determining boundary line locations; and
    8. Advising clients regarding boundary uncertainties.

  10. The applicant shall demonstrate proficiency in perpetuation in the following areas:

    1. Setting of monuments;
    2. Preparing boundary survey maps;
    3. Preparing legal descriptions;
    4. Preparing client reports explaining problems and possible solutions as necessary;
    5. Documenting in project file the basis of boundary decisions and possible adverse claims; and
    6. Preparing subdivision, topographic, right-or-way, as-built and condominium plans as appropriate.

Lan 302.03 Non-Resident Applicant. An applicant who is a non-resident and who is licensed in the state of his/her residency shall pass all examinations currently required for licensure in New Hampshire, including the N.H. state legal aspects examination, prior to consideration for licensure in this state.

Lan 302.04 Certificate of Authorization Requirements. A land surveying corporation, partnershipor proprietorship shall meet the requirements established under RSA 310-A:53 V. For the purpose of complying with the statute, full time is defined as working a minimum of 37 1/2 hours per week.

310-A:12 General Requirements for Licensure as a Professional Engineer.

  1. Applicants who have the minimum of a bachelor of science degree, or the equivalent, from an Accreditation Board for Engineering and Technology (ABET) or other accredited 4-year institution in an engineering curriculum, certification as an engineer-in-training as a result of an 8-hour NCEES fundamentals of engineering examination and 4 years of accumulated engineering experience under the direction of a licensed professional engineer and satisfactory to the board may apply to sit for the professional engineers examination.

  2. Applicants who have the minimum of a bachelor of science degree, or the equivalent, from an ABET or other accredited 4-year institution in an engineering curriculum and more than 10 years of accumulated engineering experience under the direction of a licensed professional engineer and satisfactory to the board may apply to sit for the professional engineers examination. Such an applicant may request a waiver of the fundamentals of engineering examination.

  3. Applicants with a minimum of 25 years of engineering experience of which at least 10 years shall have been in responsible charge of engineering work satisfactory to the board may apply for licensure under this section on the basis of education and experience, provided that they have successfully passed the professional engineers examination required by RSA 310-A:17.

  4. Whenever the evidence presented in an application under paragraph I, II, or III does not appear to the board conclusive and warranting the issuance of a license, the applicant shall be required to pass an oral or written examination, or both, as the board may determine.
